On February 9, 2011, the Fifth District Court of Appeal issued its opinion in Woodward Park Homeowners Association v. City of Fresno, which involved a challenge to the City of Fresno’s approval of a high-profile development project in Northeast Fresno under the California Environmental Quality Act (“CEQA”). Wanger Jones Helsley attorneys Timothy Jones and John P. Kinsey represented the developer and the City of Fresno in the proceeding, and successfully defended the project in both the trial court and in the court of appeal.
The lawsuit alleged that the environmental impact report certified by the City did not adequately analyze the project’s alleged traffic impacts and mitigation measures related to air quality. In its decision, the court of appeal ruled that the “superior court correctly rejected these contentions,” and affirmed the judgment in favor of the developer and the City.
