Timothy Jones

Areas of Practice and Experience

Timothy Jones focuses his law practice on civil litigation with a strong emphasis on real estate litigation, construction litigation, environmental litigation, and land use. His clients include environmental energy companies, national home and community builders and developers, and a large population of statewide development and agricultural interests.

Education

Timothy Jones was admitted to the Bar of the State of California in December 1985 and admitted to the Bar of the State of Washington in 1987. He graduated from Fresno State University in 1981 and the University of San Diego School of Law, cum laude, in 1985. Mr. Jones received the American Jurisprudence Award in constitutional law and wrote for the Agricultural Law Journal.

Mr. Jones has extensive litigation experience at all levels of State and federal courts on a broad range of matters.

Representitive Cases

  • Central Green v. United States. Reported at 531 U.S. 425. Mr. Jones argued the case to the United States Supreme Court and obtained a unanimous decision reversing the United States Court of Appeal for the Ninth Circuit. The case expanded governmental liability for damages caused by injuries to the people and property from or at federal water projects.
  • N L Industries v. City of Fresno, et al. (Landfill Litigation). Mr. Jones represented McClatchy Newspapers, Inc. in the case.
  • Aerojet General v. Halliburton Energy Services, Inc., et al. Mr. Jones defended Halliburton Energy Services, Inc. in Sacramento County litigation involving TCE contamination.
  • Creque v Brown & Root, Inc., et al. Mr. Jones defended Kellogg Brown & Root, Inc. in a gold mining site toxic tort litigation claim in Kern County.
  • City of Merced v. R. A. Fields, et al. Mr. Jones defended a property owner who successfully extricated himself from the litigation after motions for partial summary judgment were granted.
  • Agnew v. U.S. Homes, et al. Mr. Jones successfully resolved multi-home construction defect litigation.
  • Shea Homes v. Monschein Industries, Inc. Mr. Jones successfully defended large construction defect litigation.
  • Successfully represented members of the automobile industry in enjoining the State of California’s Zero Emissions Vehicle Regulation.
  • Currently represent members of the automobile industry in the litigation against the State of California regarding the California Greenhouse Gas Regulation (AB 1493).
  • Successfully handled, through entitlement and appeal, numerous land development projects, commercial and residential, throughout the Central Valley.
