On March 11, 2010, the Fifth District Court of Appeal affirmed the 2008 trial court decision to deny Defendants "Anti-SLAPP" motion. Justice Vartabedian, writing for a unanimous panel, agreed that the trial court did not abuse its discretion in denying the motion because the moving party failed to comply with statutory requirements. The Court further observed that the Plaintiffs properly noted the statutory violations which became the basis of the trial courts' decision.

City of Fresno, et. al. (9th Cir. 2006) 433 F. 3d 1182. Wanger Jones Helsley successfully defended 11 Citizens sued in that $27 Million action filed in the United States Eastern District in 1997.
