KINSEY
Mr. Kinsey is a Shareholder of the law firm of Wanger Jones Helsley PC. Mr. Kinsey’s practice focuses on all aspects of land use, environmental law, water law, and civil writs and appeals. He has been recognized as a certified specialist in appellate law by the State Bar of California Board of Legal Specialization, a distinction held by only a small handful of attorneys in the San Joaquin Valley. He also has significant experience advising clients on and litigating matters involving governmental ethics, administrative law, and municipal law.
Mr. Kinsey is a specialist on the California Environmental Quality Act (“CEQA”), and regularly provides instruction to non-attorneys regarding the preparation of CEQA documents.
REPRESENTATIVE MATTERS
California Environmental Quality Act & Local Land Use Laws
- Mr. Kinsey has successfully defended dozens of writ petitions challenging development projects throughout the San Joaquin Valley under the California Environmental Quality Act and State Planning and Zoning Law.
- Mr. Kinsey regularly speaks and provides training on issues related to the California Environmental Quality Act and other land use laws.

- Obtained dismissal of an appeal challenging an industrial park based on the argument that full build-out of the park rendered the action moot.
Rodriguez, et al. v. San Joaquin River Conservancy, et al.

- Successfully resolved writ proceeding against State agency that resulted in a settlement affording greater public access to the San Joaquin River.
John R. Lawson Rock & Oil, Inc. v. Air Resources Board
- 20 Cal.App.5th 77 (2018)
- Successfully argued Air Resources Board violated CEQA by using an improper baseline, and the Administrative Procedure Act by failing to adequately assess economic impacts on trucking companies. In a related appeal, obtained a reversal allowing his client, a trade group, to recover fees under California’s Private Attorney General statute.

- Obtained reversal of superior court’s discharge of writ following the California Air Resources Board’s (CARB) readoption of its Low Carbon Fuel Standard, based on CARB’s use of an erroneous baseline under the California Environmental Quality Act.

- Successfully represented Fresno’s Chaffee Zoo Corporation in action challenging expansion of the Zoo under CEQA and the Land and Water Conservation Fund Act.

- Federal Bar Association, San Joaquin Valley Chapter. Kinsey has served on the Board of Directors for the Federal Bar Association – San Joaquin Valley Chapter since January 2006. He was elected the Chapter’s President in 2011. He currently serves as the Chapter’s Treasurer.
- Association of California Water Agencies (ACWA). Kinsey serves on ACWA’s Legal Affairs Committee.
- California Association of Environmental Professionals. Kinsey served as a Director on the State Board of the California Association of Environmental Professionals, representing AEP’s Central Chapter until 2021. Mr. Kinsey also served as President of AEP’s Central Chapter from 2010 to 2013. He served as co-chair for AEP’s virtual 2020 State Conference.
- Ninth Circuit Representative. Kinsey served as a Ninth Circuit Lawyer Representative for the Eastern District of California, and as a member of the Planning Committee for the Eastern District Judicial Conference from 2010 to 2013. He served as Co-Chair of the Planning Committee for 2012 and 2013, and was also a member of the Ninth Circuit Lawyer Representatives Coordinating Committee.

Community Involvement
